1. ORGANISATEUR : SAMSONITE SAS, dont le siège social est situé 7-11 Boulevard Haussmann, 75009 Paris, France (ci-après « Samsonite »), organise le Concours Photos de Vacances (ci-après le « Concours »), tel que décrit dans les présentes conditions générales.

2. ÉLIGIBILITÉ : Le concours est ouvert à tous les résidents de France métropolitaine, ayant atteint l’âge légal, ayant acheté au moins 1 valise ou sac de voyage de marque Samsonite dans un magasin Samsonite participant en France métropolitaine entre le 1er juillet 2023 10h et le 31 août 2023 23h59. 

Les administrateurs, dirigeants, directions, employés, autres membres du personnel, agents autorisés, distributeurs et clients de Samsonite et les membres de sa famille immédiate ou de l’une de ses sociétés affiliées ou toute autre personne impliquée dans la fabrication de ce concours ne sont pas admissibles à participer ou à gagner. 

Toute participation non conforme à ces conditions générales est invalide. Samsonite se réserve explicitement le droit de refuser ou de révoquer un participant, à sa seule discrétion, dans le cas où Samsonite déterminerait qu’un participant ne respecte pas toutes les règles et réglementations contenues dans le présent document.

3. DATES DE PARTICIPATION : Le Concours est ouvert du 1er juillet 2023 à 10h au 31 août 2023 à 23h59 CET (ci-après la « Période du Concours »). La participation n’est valide que pendant la période du concours.

4. COMMENT PARTICIPER ET SÉLECTION DES GAGNANTS : Les Participants peuvent participer au Concours sur Instagram en suivant les étapes cidessous :

• prenez une photo de vous en vacances avec votre produit Samsonite ; le produit Samsonite doit être clairement visible et reconnaissable; aucune autre personne ne doit être visible sur la photo et les images ne doivent pas être offensantes, racistes, vulgaires ou de toute autre manière inappropriées; Les images ne doivent pas enfreindre les droits d’auteur, les droits à la vie privée ou à la publicité de toute personne, ou tout autre droit d’un tiers. Les photos ne doivent pas inclure d’autres sacs à main ou marques de bagages.
• Publiez votre photo sur votre compte Instagram : mettez le hashtag #monvoyagemasamsonite dans votre post, mettez votre profil en mode « public » et abonnez-vous à notre compte @mysamsonite.
• Samsonite sélectionnera les 5 meilleures photos; les photos seront jugées entièrement à la discrétion de Samsonite

Samsonite n’est pas responsable et ne considérera pas les participations incomplètes ou incorrectes. Samsonite n’acceptera aucune responsabilité pour les inscriptions non reçues pour quelque raison que ce soit, ou si les éléments fournies sont incomplets ou inexacts. 

5. CONTACT GAGNANTS : Samsonite communiquera avec les gagnants via un message personnel sur Instagram dans les 20 jours suivant la fin de la période du concours.

Si le gagnant ne peut pas être contacté ou ne confirme pas par écrit son acceptation du prix dans les 10 jours suivant la notification en répondant au message personnel sur Instagram, Samsonite se réserve le droit de retirer le prix au gagnant et d’attribuer le prix à un gagnant de remplacement ; le gagnant potentiel initial ne recevra aucune compensation. Chaque participant ne peut gagner qu’une seule fois pendant la période du concours, il n’est donc pas possible de gagner 2 prix. La date de contact peut être retardée en raison de circonstances imprévues. Les décisions prises par Samsonite sont finales sur toutes les questions relatives au concours. Samsonite ne discutera pas des résultats du concours et n’entrera dans aucune correspondance. 

6. PRIX : Le prix du concours est tel qu’indiqué et aucune somme d’argent ou autre alternative ne sera offerte. Le prix du concours n’est pas transférable et ne peut être retourné. Le prix du concours est décerné « tel quel » sans garantie quant aux services de performance sous-jacents. Samsonite n’est pas responsable des dommages directs ou indirects qui surviennent à la suite de l’utilisation ou de la perte du prix du concours, quelle qu’en soit la cause. Samsonite se réserve le droit de remplacer le Concours par un prix d’une valeur équivalente si le prix devient indisponible pour quelque raison que ce soit. Seul le propriétaire du compte Instagram recevra le prix.

Prix du concours : Samsonite Proxis Lime, Taille cabine (55cm)

Samsonite déploiera des efforts raisonnables pour expédier le Prix du Concours au gagnant qui aura confirmé l’acceptation du Prix du Concours et fourni les coordonnées demandées avec une adresse de livraison en France Métropolitaine, conformément aux présentes conditions générales. Comme option secondaire, le gagnant peut également choisir de retirer son prix dans une boutique Samsonite située en France métropolitaine, après accord avec Samsonite.

7. RÉSILIATION DU CONCOURS: Samsonite a le droit de modifier ces conditions générales, ou de résilier le concours, à tout moment à son entière discrétion sans responsabilité envers tout participant ou autre personne, sans préavis en cas de catastrophe, de guerre, de troubles civils ou militaires, de cas de force majeure ou de toute violation réelle ou anticipée de la loi ou de la réglementation applicable ou de tout autre événement en dehors de Samsonite.. Samsonite n’attribuera aucun prix en cas d’annulation du concours.

8. EXCLUSION DE RESPONSABILITÉ : Sauf indication contraire dans le document présent et dans toute la mesure permise par la loi, toutes les conditions, garanties et déclarations exprimées ou implicites par la loi sont exclues par le document présent. Dans toute les mesures permise par la loi, Samsonite exclut par le document présent toute responsabilité envers tout participant et gagnant de prix en relation avec le concours ou découlant de celui-ci, quelle qu’en soit la cause, y compris pour tous les coûts, dépenses, prix confisqués, dommages et autres responsabilités. Samsonite n’exclut pas sa responsabilité en cas de décès ou de blessures corporelles résultant de sa propre négligence. En participant au concours, le participant indemnise Samsonite contre toutes les actions, réclamations, dommages, dépenses ou responsabilités subis ou encourus directement ou indirectement par Samsonite à la suite de toute violation ou violation présumée, inexécution ou non-observation par le participant de tout accord, condition, obligation ou garantie de la part du Participant au document présent. Dans le cas où une disposition de ces conditions est jugée illégale, invalide, nulle ou autrement inapplicable, elle sera séparée des dispositions restantes qui resteront pleinement en vigueur.

9. POLITIQUE DE PROTECTION DES DONNÉES/CONFIDENTIALITÉ : En participant au concours, les participants garantissent et s’engagent à ce que les informations qu’ils soumettent soient véridiques, exactes et complètes. L’une des conditions de participation au concours est que Samsonite ait le droit de communiquer au public les noms et les photos des gagnants et les Participants acceptent par les présentes cette communication et utilisation. Toutes les autres données personnelles relatives aux gagnants du prix ou à d’autres participants sont utilisées uniquement aux fins de l’exécution du programme. 10. JURIDICTION : Les relations juridiques entre Samsonite et les Participants sont régies par les lois applicables en France. Toute action en justice ou réclamation découlant de ce concours doit être portée devant un tribunal compétent en France.

11. DÉCHARGE: Samsonite décline toute responsabilité en cas de dommages causés à tout système informatique résultant de la participation, de l’accès ou du téléchargement d’informations en relation avec ce concours, et se réserve le droit, à sa seule discrétion, d’annuler, de modifier ou de suspendre ce concours en cas de virus, bug, problème informatique, intervention non autorisée ou autres causes indépendantes de sa volonté, qui altéreraient l’administration, la sécurité ou le bon déroulement de ce concours.

En participant à ce concours, les participants conviennent qu’aucune réclamation ne sera faite contre Samsonite, ses sociétés affiliées ou l’un de ses administrateurs, dirigeants, employés ou agents respectifs à l’égard de tout dommage, droit, réclamation ou action de quelque nature que ce soit résultant de leur participation à ce concours et/ou de l’acceptation et de la jouissance du prix du concours.

Le concours ne prend pas place là où la loi l’interdit. Dans la mesure permise par la loi, le droit d’intenter une action en justice, de demander une injonction ou de recourir à toute autre procédure judiciaire ou autre en cas de litiges ou de réclamations résultant de ou en relation avec le présent concours par le document présent est exclu et tout participant renonce expressément à tous ces droits.

12. INSTAGRAM : le Concours n’est en aucun cas sponsorisé, approuvé ou administré par, ou associé à Instagram.

1. ORGANIZER: SAMSONITE SAS, with registered office at 7-11 Boulevard Haussmann, 75009 Paris, France (hereafter “Samsonite”), is organizing the Summer Pictures Contest (hereafter the “Contest”), as described in these terms and conditions.

2. ELIGIBILITY: The contest is open to all residents of Metropolitan France, that have obtained the legal age, and have bought at least 1 Samsonite branded suitcase or travel bag in a participating Samsonite owned store in Metropolitan France in the period between 1 July 2023 10 a.m. and 31 August 2023 11.59 p.m.

Directors, officers, management, employees, other staff, authorized agents, distributors and wholesale customers of Samsonite and immediate family members thereof or any of its affiliated companies or any other persons involved in the making of this Contest are not eligible to enter or win.

Any participation not complying with these terms and conditions is invalid. Samsonite explicitly reserves the right to refuse or remove a Participant, at its sole discretion, in the event Samsonite determines a Participant does not comply with all rules and regulations as contained herein. 

3. ENTRY WINDOW: The Contest is open from 1 July 2023 10 a.m. until 31 August 2023 at 11.59 p.m. CET (hereafter the “Contest Period”). Participation is only valid during the Contest Period.

4. HOW TO PARTICIPATE AND SELECTION: The Participants can enter the Contest on Instagram as follows: 

• take a picture of yourself on holiday with your Samsonite product; the Samsonite product must be clearly visible and recognizable; no other persons should be visible on the picture and pictures cannot be offensive, racist, vulgar or in any other way inappropriate; pictures shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party. Pictures should not include any other handbags or luggage brands.
• post your picture on your Instagram account: put the hashtag #monvoyagemasamsonite in your post, set your profile to ‘public’ mode, and subscribe to our account @mysamsonite
• Samsonite will select the 5 best pictures; the pictures will be judged entirely at the discretion of Samsonite 

Samsonite is not responsible for and will not consider incomplete or incorrect entries. Samsonite will not accept responsibility for entries not received for whatever reason, or if contact details provided are incomplete or inaccurate. 

5. WINNER NOTIFICATION: The winner will be contacted by Samsonite via a personal message on Instagram within 20 calendar days following the end of the Contest Period. If the winner cannot be contacted or does not confirm in writing acceptance of the prize within 10 calendar days of notification by replying to the personal message on Instagram, Samsonite reserves the right to withdraw the prize from the winner and allocate the prize to a replacement winner and the original possible winner shall not receive any compensation. Each Participant can only win once during the Contest Period, so it is not possible to win 2 prizes. The contact date may be delayed due to unexpected circumstances. Decisions made by Samsonite are final on all matters relating to the Contest. Samsonite will not discuss the Contest results and will not enter into any correspondence. 

6. PRIZES: The Contest Prize is as stated and no cash or other alternatives will be offered. The Contest Prize is not transferable and cannot be returned. The Contest Prize is awarded “as is” without warranty regarding the underlying services of performance. Samsonite is not responsible for direct or indirect damages that occur as the result of the use or loss of the Contest Prize, regardless of cause. Samsonite reserves the right to substitute the Contest Prize with a prize of an equivalent value should the Contest Prize become unavailable for any reason. Only the owner of the Instagram account will receive the Contest Prize.

Contest Prize: Samsonite Proxis Lime, Cabin size (55cm)

Samsonite will use reasonable efforts to ship the Contest Prize to the winner who have confirmed acceptance of the Contest Prize and provided the requested contact details with a delivery address in Metropolitan France, in accordance with these terms and conditions. As a secondary option, the winner may also opt to collect the Contest Prize at a Samsonite owned store located in Metropolitan France, after agreeing with Samsonite.

7. TERMINATION OF THE CONTEST: Samsonite has the right to vary these terms and conditions, or terminate the Contest, at any time at its absolute discretion without liability to any entrant or other person, without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of applicable law or regulation or any other event outside of Samsonite’s control. Samsonite will not award any prize if the Contest is terminated.

8. EXCLUSION OF LIABILITY: Except as specifically set out herein and to the maximum extent permitted by law, all conditions, warranties and representations expressed or implied by law are hereby excluded. To the fullest extent permitted by law, Samsonite hereby excludes and shall not have any liability to any Participant or prizewinner in connection with or arising out of the Contest howsoever caused, including for any costs, expenses, forfeited prizes, damages and other liabilities, save that Samsonite does not exclude its liability for death or personal injury as a result of its own negligence. By entering the Contest, the entrant indemnifies Samsonite against any and all actions, claims, damages, expenses or liabilities suffered or incurred directly or indirectly by Samsonite in consequence of any breach or alleged breach, non-performance or non-observation by the Participant of any agreement, conditions, obligation or warranty on the part of the Participant herein. In the event that any provision of these terms are held to be illegal, invalid, void or otherwise unenforceable, it shall be severed from the remaining provisions which shall continue in full force and effect.

9. DATA PROTECTION/PRIVACY POLICY: By entering the Contest, Participants warrant and undertake that the information submitted by them is true, accurate and complete. It is a condition of entry to the Contest that Samsonite has the right to communicate to the public the names and the pictures of the prizewinners and Participants hereby agree to such communication and use. Any other personal data relating to the prizewinners or other Participants are used for the purposes of running the Contest only. 10. JURISDICTION: Legal relationship between Samsonite and the Participants is governed by the applicable laws of France. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction in France.

11. RELEASE: Samsonite disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Contest, and reserves the right, in its sole discretion, to cancel, modify or suspend this Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond its reasonable control, corrupt the administration, security or proper play of this Contest.

By participating in this Contest, Participants agree that no claim shall be asserted against Samsonite, its affiliates or any of its respective directors, officers, employees or agents in respect of any damages, rights, claims or actions of any kind whatsoever that result from their participation to this Contest and/or acceptance and enjoyment of the Contest Prize.

The Contest is void where prohibited. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and any Participant expressly waives any and all such rights.

12. INSTAGRAM: the Contest is no way sponsored, endorsed or administered by, or associated with, Instagram.
